The Supreme Court invalidates the Voting Rights Act's preclearance requirement in Shelby County v. Holder, reducing federal election oversight.

The Reconstruction era began against a backdrop of a Constitution that protected slavery through the Three-Fifths Compromise and a Supreme Court that denied Black Americans citizenship in the Dred Scott decision. Lincoln's Emancipation Proclamation and the passage of the 13th Amendment formally abolished slavery, though Southern states immediately weaponized Black Codes to restrict Black freedom. The 14th and 15th Amendments then established birthright citizenship, equal protection, and Black male suffrage, representing a sweeping constitutional revolution. Congress passed Enforcement Acts to defend these new rights against Klan violence, but the Supreme Court steadily undermined federal authority in the Civil Rights Cases and Plessy v. Ferguson. These rulings entrenched segregation and disenfranchisement for nearly a century, until the Voting Rights Act of 1965 restored Black voting rights—only for the Supreme Court to weaken those protections decades later in Shelby County v. Holder.

Before the Civil War, free Black activists challenged colonization schemes while abolitionists debated whether the Constitution could be used to fight slavery, laying the ideological groundwork for Reconstruction. Lincoln initially pursued compensated emancipation and colonization, but Attorney General Bates confirmed Black birthright citizenship even before the amendments were drafted. The legislative process for the 14th Amendment involved fierce fights over representation formulas and was ultimately packaged as a bundled proposal pushed through over President Johnson's vocal opposition. Radical Reconstruction imposed military rule on the South to enforce Black suffrage, and the 15th Amendment's ratification was championed by the newly inaugurated President Grant. Southern Democrats responded with open paramilitary violence to reverse these gains, and Republicans' last major federal effort—the Federal Elections Bill—was ultimately defeated, marking the collapse of the national commitment to protecting Black voting rights.

Foner argues the Reconstruction amendments should be boldly reinterpreted to combat ongoing socioeconomic inequalities rooted in the legacy of slavery.

Before the Civil War, free Black conventions articulated a vision of birthright citizenship, and Lincoln's final speech signaled a historic shift toward Black suffrage just before his assassination. As the Reconstruction amendments were drafted, Congressman Bingham and Senator Howard introduced transformative legal concepts—equal protection and incorporation of the Bill of Rights—that would shape American law for generations. The 15th Amendment's deliberately negative framing left critical loopholes, and the Supreme Court's rulings in the Slaughterhouse Cases and United States v. Cruikshank then systematically stripped federal power to enforce these new rights. The Brotherhood of Liberty's sweeping legal critique and Justice Harlan's lone dissent in Plessy v. Ferguson kept alive an alternative constitutional vision of racial equality that the majority refused to adopt. The Warren Court eventually overturned Plessy, but modern controversies over birthright citizenship and Foner's closing call for bolder reinterpretation of the amendments demonstrate that the second founding remains unfinished business.
